Privacy Policy

Important: memories are public by default

Unless you deliberately require a password or turn public access off, a published Kioku memory can be viewed by anyone who receives or discovers its link or QR code. Viewers do not need a Kioku account. Links can be forwarded, and public content may be copied, downloaded, reshared, or discovered by third parties or search engines.

This Privacy Policy explains how Kioku Memory (“Kioku,” “we,” “us,” or “our”) collects, uses, stores, and shares information when you use the Kioku website, memory pages, memory albums, QR features, and related services. Kioku Memory is operated by its owner in Arizona, United States.

1. Information we collect

  • Account information: your name, email address, authentication information, account preferences, and plan or storage information.
  • Memory and album content: videos, audio, photographs, titles, descriptions, dates, categories, names, written stories, album details, guest submissions, and other information you choose to upload or publish.
  • Delivery information: recipient email addresses, release dates, and delivery notes for scheduled memories.
  • Transaction information: subscription tier, billing status, purchase history, and transaction identifiers. Payment providers process payment-card information; Kioku does not store full payment-card numbers.
  • Technical and usage information: IP address, browser and device information, timestamps, page requests, error records, and security or service logs generated when you use Kioku.
  • Communications: information you include when you contact Kioku for help, privacy requests, reports, or feedback.

2. How we use information

We use information to:

  • create and administer accounts;
  • store, process, publish, and deliver memories and memory albums;
  • generate public pages, links, QR codes, and design assets;
  • provide access controls, password protection, and scheduled delivery;
  • process subscriptions and manage plan entitlements;
  • review content for safety, rights, and publication eligibility;
  • send service, account, security, and delivery communications;
  • prevent abuse, investigate reports, and protect Kioku and its users;
  • maintain, troubleshoot, and improve the service; and
  • comply with law and enforce our Terms of Use.

3. Public memories, memory albums, and password protection

A memory becomes publicly accessible when it is published or, for a scheduled memory, when its release conditions are met, unless the owner has turned public access off. If password protection is not enabled, anyone with or discovering the active page address or QR code can view it without signing in.

Password protection restricts the memory page to visitors who enter the password. It does not make the content immune from copying or sharing by an authorized viewer, and no access-control system can guarantee absolute confidentiality. You are responsible for choosing a strong password and sharing it only with intended viewers.

Owners may turn public access off or reset a Memory's sharing link. These controls affect access through Kioku but cannot erase copies, screenshots, downloads, recordings, or reposts already made elsewhere.

Kioku may show Memory owners aggregate activity information such as total views, QR accesses, shared-link opens, and the most recent view time. Owner-facing activity does not display visitor IP addresses.

Published memory albums are public and may display approved memories, names, photos, videos, and guest contributions. Guest-upload forms explain when submitted material may appear in a public album.

Deleting content from Kioku does not remove copies, screenshots, downloads, or reposts previously made by other people or services.

4. Automated content review

Kioku may use automated tools and human review to evaluate memories, memory albums, and guest submissions for safety, unlawful material, rights concerns, or compliance with our rules. Content and related context may be processed by service providers that help perform this review. Automated review can make mistakes, and you may contact us if you believe a decision should be reconsidered.

When a memory contains audio or video, Kioku may provide a temporary, access-limited copy to AssemblyAI so speech can be transcribed for safety review. Kioku does not save the transcript text in its database and requests deletion of the provider's transcript after the review result is recorded. Operational details such as job status and timestamps may be retained for security, troubleshooting, and audit purposes.

When visual video review is enabled, Kioku may also provide a temporary, access-limited video copy to Mux so representative frames can be checked for sexual or violent imagery. Kioku requests deletion of the temporary Mux video asset after the final review result is recorded. Provider job identifiers, scores, and timestamps may be retained for security, troubleshooting, and moderation audit purposes.

5. How information is shared

We may share information in the following circumstances:

  • At your direction or through public features: when you publish a memory or album, distribute a link or QR code, invite contributions, or otherwise choose to share content.
  • Service providers: companies that provide cloud hosting, storage, authentication, payments, email delivery, content review, security, analytics, and technical operations. They process information to provide services to Kioku.
  • Legal and safety reasons: when reasonably necessary to comply with law, legal process, or valid government requests; enforce our agreements; investigate fraud or abuse; or protect rights, safety, and security.
  • Business changes: in connection with a financing, reorganization, sale, merger, or transfer of all or part of the Kioku service, subject to applicable law and existing privacy promises.

Kioku does not sell personal information for money and does not use memory content for third-party behavioral advertising.

6. Retention and deletion

We retain account information and content while your account is active and for as long as reasonably necessary to operate Kioku, complete requested deliveries, resolve disputes, prevent abuse, meet legal or financial obligations, and enforce agreements. Retention periods vary by data type and purpose.

If a paid account moves to a plan with lower limits, Kioku provides a 30-day grace period for the account owner to choose what remains active, request a free data archive, or select another plan. Content exceeding the new plan limits then goes offline and is scheduled for permanent deletion 90 days after the downgrade.

You can edit or delete memories through your account. You may request complete account deletion from the Account page or by emailing us. Once a verified account-deletion request begins processing, public content is made unavailable and Kioku provides a 30-day recovery period before permanent deletion, except where immediate action is requested or required.

Deleted data may remain temporarily in backups, logs, fraud-prevention records, payment records, or records we must retain by law before being removed or overwritten in the ordinary course. Such retained copies are not kept publicly accessible through Kioku.

7. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. No online service, storage system, password, or transmission method is completely secure. Keep your account and memory passwords confidential, and contact us promptly if you suspect unauthorized access.

8. Your choices and privacy requests

You may:

  • review and update account or memory information;
  • choose public access, password protection, or turn public access off;
  • reset a Memory sharing link when you need to invalidate older Kioku links and QR codes;
  • delete memories and manage memory albums through your dashboard;
  • request a free archive of your account data and uploaded media;
  • request access, correction, or deletion of personal information;
  • request complete account deletion; and
  • ask questions or appeal a content-review decision.

We may need to verify your identity before completing a request. Some information may be retained when required or permitted by law. Rights may vary depending on where you live.

9. Children and content featuring children

Kioku accounts are for people age 18 or older. Kioku is not directed to children under 13, and children may not create accounts. Adults may create memories that feature children only when they have the legal right and any permission needed to upload, store, and publish that child's image, voice, video, and other information.

If you believe a child has created an account or personal information about a child was submitted without appropriate authority, contact us so we can review and take appropriate action.

10. Changes to this policy

We may update this policy as Kioku changes. We will post the revised policy and update the date above. If a change materially affects how we use information already collected, we will provide additional notice or seek consent when required by law.
